Westfield Insurance Privacy Notice – U.S. Insurance

This Insurance Privacy Notice applies to individuals who apply for or engage in transactions with our Westfield U.S, insurance companies that are used for personal, family, or household needs, including policyholders, insureds, claimants or beneficiaries, potential witnesses, other individuals who are the subject of information collected in connection with an insurance transaction, and applicants for our insurance products.  It describes our practices with respect to the nonpublic personal information (referred to herein as “personal information”) we collect about you and how we use and may disclose it to others and rights you may have with respect to that information under federal and state law, depending upon the state of your residency.  

Please note this Insurance Privacy Notice does not apply to interactions you may have with us that are not related to insurance policies, claims, or other transactions.  Please see our Privacy Notice information page for other potentially applicable privacy notices. 

Information We Collect 

Insurance applicants, policy holders, and insureds

We may collect and process the following personal data of applicants, policy holders, and insureds:

• Personal identifiers – Name, address, phone number, email address, date of birth, governmental ID information (including driver’s license information), IP addresses, MyWestfield account number and password, insurance policy number(s)
• Protected class and sensitive data – Gender, health information, family composition information, demographic information
• Commercial and financial information – Insurance products purchased or considered from us, our affiliates, or other companies; other insurance companies you use; products or services used or considered; credit report / background check information; bank account or other payment-related information (e.g., credit or debit card information); payment and claims history; information about ownership of homes or vehicles insured; marketing preferences
• Insurance account and claim information – Information about current or previous claims submitted to us or other insurance companies; insurance coverage types, limits and rates; driving record information
• Internet or other electronic activity information – IP address; your device and browser type; your browsing and search history on our websites or app utilization; and information regarding your interaction with our websites, app, and our advertisements
• Geolocation information – location of your mobile phone if you use our MissionSafe telematics product
• Audio information – voice recordings of customer service calls
• Telematic information from your mobile phone (MissionSafe) – if you use our MissionSafe telematics product, we may collect the following types of personal information from your mobile phone while you are in a vehicle: accelerometer (acceleration), gyroscope, barometer, and magnetometer data; information about the position of your phone that is used to detect movement; information about your phone’s use state and your interaction with the phone when you’re driving (e.g., whether phone call is in progress and whether music is being played; whether screen is on or off; Bluetooth connections made); phone settings; information about when a trip is in progress and the time of a trip; inferences derived from the foregoing data regarding driving characteristics  
• Professional or educational information – your employer, job title and job history
• Other information you may provide to us

Claimants and Related Individuals

In order to process claims, we may collect and process the following categories of personal information; this is in addition to any additional information we may collect and process about you as a policy holder or applicant (as described above): 

• Personal identifiers – Name, address, phone number, email address, date of birth, governmental ID information (including driver’s license information), insurance policy number(s), claim number(s)
• Protected class and sensitive data – Health information
• Commercial and financial information – Insurance products purchased from us, our affiliates, or other companies; other insurance companies you use; insurance products or services used; credit report / background check information; bank account or other payment-related information (e.g., credit or debit card information); payment and claims history; information about ownership of homes or vehicles insured
• Insurance account and claim information – Information about current or previous claims submitted to us or other insurance companies; insurance coverage types, limits and rates; driving record information
• Audio, visual, electronic information – voice recordings of customer service calls; photos or videos associated with insurance claims
• Other information you may provide to us

Purposes for Collection of Personal Information

We collect your personal information to provide our services, which may include the following: 

• To offer and provide our insurance products and services
• To improve the products and services that we provide
• To contact you
• To evaluate claims you or others may submit 

Sources of Personal Information

We collect personal information from you directly, including from your insurance application, registration for product or service offerings, and from insurance claims submitted.  If you register for the MissionSafe application, we collect personal information from your mobile device and information about the movement and position of your phone from Google Play Services (for Android devices) and Apple (for iOS devices).

We also collect personal information from insurance agents or other intermediaries involved with the purchase of insurance or processing of claims information; third parties that may submit insurance claims involving you; public records; consumer reporting agencies and other entities that assemble or collect information that we use to provide insurance or detect or prevent fraud or material misrepresentations or failures to disclose material facts in the insurance context (“insurance support organizations”) that may provide information about past claims; histories of accident or traffic violations; other insurance companies; medical professionals, and other third parties that provide information related to your application or insurance claims, as appropriate.   

Information we may obtain from a report prepared by an insurance support organization may be retained by such organizations and disclosed to other persons.

Disclosures of Personal Information

We may disclose one or more categories of personal information identified herein for our everyday business purposes, such as to process and investigate claims and transactions, to provide services you register for such as driver metrics, to evaluate your application for insurance and related products, to respond to court orders and legal investigations, and to make reports to credit bureaus; for our marketing purposes; for joint marketing with other financial companies; and to prevent fraud and protect the security of our systems, including to verify your identity and authenticate your communications with us; and as otherwise permitted under applicable law.

We may disclose the personal information we collect about you, as described above to our affiliates, to companies that perform marketing services on our behalf, and to other third parties, all as permitted by law. 

Information About Disclosures to Affiliates and Nonaffiliates

Affiliates are companies related by common ownership or control.  We may disclose to our affiliates personal information regarding your transactions and experiences. Nonaffiliates are companies that are not related by common ownership or control, such as third-party service providers. While we may disclose personal information to nonaffiliates for our purposes, we prohibit nonaffiliates from using such information to market their own products or services to you. 

Additional Information About How We May Disclose Personal Information and Purposes for Disclosures

We may also disclose your personal information as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property or the rights, property or safety of others, including to law enforcement agencies, and judicial and regulatory authorities. We may also disclose your personal information to third parties to help detect and protect against fraud or data security vulnerabilities. And we may disclose or transfer your personal information to a third party in the event of an actual or potential sale, merger, reorganization of our company or affiliates, or other restructuring.

How We Protect Your Information

We implement administrative, technical, and physical safeguards and security measures designed to secure and protect your personal information. Please note, however, that we cannot fully eliminate security risks associated with the storage and transmission of personal information.

Third Party Websites and Content

Our websites and apps may contain links to third parties or content that is supplied by a third party, and those third parties may collect personal information about you, including without limitation, usage information and your device identifier, when you interact with them.  In the case of third-party social media widgets, these technologies may provide information to their associated social networks or third parties about your interactions with our webpages that you visit, even if you do not click on or otherwise interact with the plug-in or widget. Information is transmitted from your browser and may include an identifier assigned by the social network or third party, information about your browser type, operating system, device type, IP address, and the URL of the webpage where the widget appears. This Insurance Privacy Notice does not apply to, and we are not responsible for the data collection and privacy practices employed by any of these third parties. We encourage you to review their privacy notices. 

Retention

We will retain your personal information for as long as is necessary to fulfil the purposes for which we obtained the information, including to provide our services, or for such longer period as may be required or permitted by applicable law. We will also retain your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements and policies. We use the following criteria to set our retention periods: (1) the duration of our relationship with you; (2) the purposes for processing the information; (3) the existence of a legal obligation; (4) our contractual obligations; and (5) the advisability of retaining the information in light of our legal position (for example, in light of applicable statutes of limitations, litigation or regulatory investigations).

Rights Regarding Your Personal Information

You may have the following rights: 

• Right of access – The right to know what type of information we keep about you and to obtain a copy of it, subject to legally permitted exceptions
• Right to correct – If you believe the information about you in our records is incorrect, you may request that we correct it and provide us your reasons for doing so.
