Customer Panel Terms of Use & Privacy Promise

WESTFIELD®

Westfield is a trade name and a registered trademark of the Ohio Farmers Insurance Company and its subsidiary insurance companies and affiliated companies, providing insurance and related services (collectively herein, “Westfield”, “we”, “our”, or “us”). The Westfield Customer Panel refers to this website and the associated polls, panels, and surveys contained or accessed herein (collectively herein, “Panel”).

Please read the Customer Panel Terms of Use & Westfield’s Privacy Promise (collectively herein, “Terms”) carefully because they govern your eligibility and participation in any Panel activity.

By agreeing to participate in the Panel, you accept and agree to be bound by these Terms. If you do not agree, please immediately cease all access to the Panel website and all participation in Panel activities.

ELIGIBILITY AND REGISTRATION

You must be eighteen (18) years of age or older to join the Panel.

You must also provide us with true, current, and complete information about your identity – any instances of a Panel participant knowingly providing false information regarding that participant’s profile or customer status will be grounds for the participant’s immediately removal and such individual shall be barred from Panel membership. We will check the truthfulness and completeness of registrations. If you do not comply with the conditions for eligibility, or provide false information, or make multiple false applications, we may terminate your membership.

We reserve the right to refuse membership and/or participation in particular surveys or activity to anyone for any reason.

It is your responsibility to obtain, at your own expense, all equipment and third-party services (e.g., computer and internet access) required for you to access and use the Panel.

You agree to maintain an up-to-date email address and name on file with us to remain eligible for ongoing participation.

Inactive members (those who have not participated in any Panel activity for 12 months) will be removed from the Panel.
Your membership and your invitation to participate in Panel activities are subject to additional conditions we may set from time to time based upon our needs.
 
New Panel members will be invited as necessary.

Your choice to participate in any Panel activity, or not participate, is always 100 percent voluntary and will have no effect whatsoever on your eligibility for insurance or on any rating of your policy.

As a Panel member, you agree to accept communications from us by email. Emails from the Panel are not marketing emails. The Panel will never send you direct marketing or advertisements for any products.

If you choose to opt out of Panel communications, you will no longer receive any email invitations to participate in future Panel activities to that specific email address. Please note opting out of Panel communications will have no effect on communications regarding your Westfield insurance policy and/or claims, if any, and vice versa. 

USE OF PANEL 

You agree you will not use the Panel to take any of the following actions:
• Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others;
• Publish, post, upload, email, distribute, or otherwise disseminate (collectively, “transmit”) any content that injures others or is inappropriate, profane, defamatory, infringing, pornographic, obscene, indecent, vulgar, unlawful, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, or that otherwise could result in civil or criminal liability;
• Engage in any illegal activities or incite illegal activities under U.S. or your state or local law;
• Transmit any content prohibited by intellectual property (e.g., copyright, trademark, trade secret, or privacy and publicity) or other laws, unless you are the owner or have permission to use such rights;
• Infringe on any of Westfield's intellectual property (including this Panel). Specifically, you may not copy, modify, republish, distribute, or create derivative works of the Panel, any survey, or other Panel content;
• Transmit content that contains viruses, corrupted files or any other software or functionality that may damage or adversely affect the operation of any other person's computer;
• Interfere with the security or rights of Westfield, any other user or any third party;
• Impersonate any other person or entity including our representatives, or misrepresent your affiliation; or
• Participate in or facilitate any effort to artificially manipulate the results, scoring or evaluation of content in the Panel.

SUBMITTED USER CONTENT

The Panel permits you to upload or post or otherwise submit to Westfield various forms of content, such as comments, suggestions, concepts, or other information disclosed or offered to us by you through the Panel (collectively herein “Content”) or in response to solicitations or surveys from the Panel. By submitting any Content in any form to Westfield, you hereby grant Westfield, its affiliates, successors and assigns, a perpetual, worldwide, irrevocable, royalty-free, non-exclusive, transferable, sub-licensable and assignable 
right and license to use, reproduce, create derivative works of, perform, display, transfer, transmit, translate, distribute, and publish any or all of your responses, in any media or technology now or hereafter known.

You understand and acknowledge we have both internal resources and other external resources which may have developed or may in the future develop ideas identical to or similar to the Content you provide and that we are only willing to consider your Content on these Terms. In any event, any Content is not submitted in confidence and we assume no obligation, express or implied by considering it. To the extent, you may have any 'moral rights' (such as rights of attribution or integrity of a work), you release, waive and agree not to assert any such rights against us or any of our licensees or assigns.

In addition, you agree we have no responsibility or liability for the deletion, corruption, or alteration of, or failure to store any Content you submit to Westfield.

CUSTOMER PANEL PRIVACY PROMISE

The Panel was developed and is maintained by Forsta on behalf of Westfield. Both Westfield and Forsta are committed to protecting the privacy of this online Panel.

Summary

Your identity and the Content you submit to the Panel are completely confidential.  We do not release the individual information of Panel members unless the individual expressly agrees to such disclosure. We do not sell or rent your information to anyone. We do not send unsolicited commercial emails.

Information We Collect About You

The Panel gathers demographic information such as age, occupation, and other personal characteristics as you fill out the profile and participate in surveys. The registration process requires you to provide us with contact information such as name, email address, and state of residence.

How we use this information

We track the registration and demographic information so we can send surveys that correspond to members’ characteristics and interests. We also summarize information about the Panel to develop statistics, ensuring the Panel is representative of consumers across the country. Contact information is used only when the Panel needs to communicate with Panel members. We will never sell your personal information nor will we share it with any other party without your explicit permission.

Information gathered through the surveys is aggregated and analyzed in reports for Westfield. The Content you provide is valuable in understanding the needs, interests, and lifestyles of consumers. Research reports shared within Westfield contain only aggregated and de-identified information.

You may opt out of the Panel at any time by following the directions at the bottom of
every email you receive from us. Upon termination of your participation in the Panel, we will delete your account and all associated profile information. We may retain any Content you submitted in de-identified form. Your participation in any given survey is entirely voluntary. Even if you end your relationship with us, we will continue to adhere to the Terms for as long as we have your information.

TERMINATION

We may terminate or suspend these Terms, your Panel membership, or your use of any or all of the Panel, in whole or in part at any time and for any reason.

Similarly, you may terminate your Panel membership and these Terms. Please allow five business days for the membership cancellation request to process.

CHANGES IN TERMS OF USE

We reserve the right to modify these Terms from time to time without notice. Please review these Terms from time to time so that you will be informed of any changes. Each time you access the website you affirm your agreement to and acceptance of the most current version of these Terms.
